H-1B1
Chile and Singapore professionals
The H-1B1 is a work visa for citizens of Chile and Singapore, created by U.S. free trade agreements with those countries. It covers the same kind of degree-level jobs as the H-1B, with separate annual numbers and no lottery. Most people apply directly at a U.S. consulate with a certified Labor Condition Application (LCA), with no petition to U.S. Citizenship and Immigration Services (USCIS) needed first.

What the case needs
- 01Citizenship of Chile or Singapore. Permanent residence there does not qualify.
- 02A job offer from a U.S. employer in a specialty occupation.
- 03A degree in a related field, generally a bachelor's or higher. The Chile agreement lists a few occupations that accept other credentials.
- 04A Labor Condition Application (LCA) certified by the Department of Labor for the H-1B1 role.
- 05Intent to leave the U.S. when your status ends. The H-1B1 requires this, which makes green card planning more delicate.
Your case, start to finish.
An attorney confirms that the role qualifies as a specialty occupation and that your degree fits it.
We prepare the LCA and an employer support letter. Our tools check that duties, wage, and worksite match across both.
We prepare you for the consular interview, including how to show that you plan to leave when your status ends.
If you are already in the U.S., we weigh a USCIS filing against a consular application based on your timing and travel plans.
Before you ask.
How is the H-1B1 different from the H-1B?
The job and degree requirements are similar. The H-1B1 has no lottery, is granted one year at a time, and requires that you intend to leave the U.S. when your status ends.
Can I renew it?
Yes. Extensions are granted one year at a time, with no fixed maximum. Each renewal looks again at whether you still intend to leave when your status ends.
Can I apply for a green card while on an H-1B1?
It is possible, and timing matters. Because the H-1B1 requires intent to leave, a green card filing can affect your next renewal or entry. We plan the sequence with you, and some people move to an H-1B or O-1 first.
Can my family come with me?
Your spouse and unmarried children under 21 can join you in H-4 status. H-4 work authorization is tied to H-1B workers on a green card path, so H-4 spouses of H-1B1 workers generally cannot work.
